BY USING YOUR LOUISVILLE SLUGGER NON-WOOD BAT, YOU AGREE TO ALL TERMS OF THIS WARRANTY. BEFORE USING YOUR BAT, PLEASE READ THIS WARRANTY CAREFULLY. IF YOU DO NOT AGREE TO THE TERMS OF THIS WARRANTY, DO NOT USE YOUR BAT. RETURN YOUR RACKET TO THE DEALER FROM PURCHASE. SEE THE RETAILER'S RETURN POLICY FOR MORE DETAILS AND/OR ADDITIONAL RETURN REQUIREMENTS.

This warranty includes a binding agreement to arbitrate and a class action waiver for US residents. If you live in the United States, the binding arbitration agreement and class action waiver affect your rights under this warranty. Please read the text in the “Binding Arbitration Agreement” section; Class Action Waiver (U.S. Residents Only)” carefully.

1 YEAR LIMITED WARRANTY

Under this Limited Warranty, Louisville Slugger will provide, within 1 year from the date of purchase ("Warranty Period"), a one-time repair or replacement of your non-wooden putter for the following 3 conditions resulting from normal use in the location -- (1) severe dents, (2) structural cracks, or (3) broken lids or knobs.IF YOUR BAT EXPERIENCES (1) EXTREME LACIDITY, (2) STRUCTURAL TEARING, OR (3) BROKEN COVERS OR BUTTONS, PLEASE DISCONTINUE USING THE BAT AND FILE A WARRANTY CLAIM.To qualify for warranty service, you must be the original purchaser of the slug and provide proof of purchase from an authorized Louisville Slugger dealer.

WARRANTY DOES NOT COVER
  1. Bats subjected to abuse, mistreatment or disregard of care instructions (including use in commercial cages);
  2. Damage other than the 3 listed above (i.e. normal wear and tear/cosmetic damage);
  3. Bats that have undergone unauthorized modifications or alterations, including rolling, scraping or other means of "alteration";
  4. Bats purchased from unauthorized retailers(including bats purchased through (i) auction sites such as eBay or Craigslist, (ii) unauthorized resellers who sell through third-party marketplaces such as Amazon Marketplace, or (iii) resellers who sell altered or tampered bats); or,
  5. Bats with holograms or date codes removed or defaced.
THIRD PARTY CERTIFICATIONS

Any markings, graphics or decals placed on a Louisville Slugger stick to indicate that the stick is certified or meets a specified third-party standard (e.g. BBCOR, USA Baseball or USSSA) only represent that the racquet was certified at the time of manufacture. and not at a later date. In the event that a bat so certified or approved at the time of manufacture subsequently loses such certification or approval, the Louisville Slugger may, in its sole discretion, develop a program to upgrade, repair, or replace the bat and/or provide a coupon valid for use. to purchase other Louisville Slugger products at www.slugger.com or www.wilson.com. In such cases, remedies provided under such a program shall, to the fullest extent permitted by applicable law, be the sole and exclusive remedies available to owners of affected bats.

MAKE A WARRANTY CLAIM

DO NOT RETURN YOUR RACKET TO YOUR SPORTS DEALER. Visit www.slugger.com and complete the Bat Warranty Form online for a warranty claim number and return address, or call the Louisville Slugger Bat Care Center at 1-800-401-7908. Call the Louisville Slugger Bat Care Center at 1-800-401-7908 for warranty claims on custom models.

To validate your warranty, you must send your bat to the Louisville Slugger Bat Care Center along with valid proof of purchase.If Louisville Slugger determines that your racquet is covered under warranty, Louisville Slugger will, at its sole discretion and option, either (1) repair your racquet or (2) replace your racquet with the same racquet or (3) replace your racquet with a comparable racquet if your racquet is discontinued or unavailable, or (4) provide you with a coupon to be used toward the purchase of other Louisville Slugger products at www.slugger.com or www.wilson.com. If Louisville Slugger determines that your racket is not covered by this Limited Warranty, we will return your racket to you. Note - A replacement racquet does not start a new one year warranty period.

Note - Louisville Slugger reserves the right to refuse warranty service to anyone who, in Louisville Slugger's sole discretion, is abusing its products or warranty policies.

CARE INSTRUCTIONS FOR NON WOODEN BATHS

This racket requires special care as it is built with thin walls to improve performance. Note that in cold weather (below 60°F) your racket is prone to damage, which significantly increases the hardness of the ball. High compression balls can also shorten the life of your racquet, as well as team use situations. Do not hit the racquet against metal pegs, rocks or anything other than regular game balls, as this will damage your racquet and void your warranty. Use only mild detergent and water for cleaning. DO NOT use solvents or ammonia-based products.

What to do if you are not satisfied with the service

If you believe that the Louisville Slugger has failed to fulfill any of its obligations under this warranty, you may attempt to resolve the matter informally with the Louisville Slugger. If you are unable to resolve the matter informally and wish to make a formal claim against the Louisville Slugger, and if you are a resident of the United States, you must submit your claim to binding arbitration in accordance with the procedures described below, unless an exception is made. apply. Submitting a claim to binding arbitration means that you do not have the right to have your claim heard by a judge or jury, either as an individual or as part of a consumer group. To the extent permitted by applicable law, filing fees for initiating and conducting an arbitration will be shared between you and Louisville Slugger, but in no event will your fees exceed the amount allowed by the American Arbitration Association, at which time Louisville Slugger assumes all fees and additional administrative expenses. Louisville Slugger waives its right to recover attorneys' fees in connection with any arbitration under this warranty. If you are the prevailing party in any arbitration to which the Supplementary Procedures for Consumer Disputes apply, you are entitled to a refund of attorneys' fees, as determined by the arbitrator.

The dispute will be governed by the laws of the state or territory where you reside at the time of purchase (if in the United States). The place of arbitration will be Cook County, Illinois or your country of residence (if in the United States). The arbitrator shall have no authority to award punitive or other damages other than actual damages suffered by the prevailing party, except as required by law. The arbitrator will not award consequential damages and any award will be limited to monetary damages and will not contain any equitable relief, injunctive relief or order of any party other than an order to pay a sum of money. The arbitrator's judgment on the award will be binding and final, except for appeals under the Federal Arbitration Act, and may be entered in any court of competent jurisdiction. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ANY DISPUTES, WHETHER IN ARBITRATION, COURT OR OTHERWISE, WILL BE RESOLVED ONLY ON AN INDIVIDUAL BASIS. LOUISVILLE SLUGGER AND YOU AGREE THAT EACH PARTY HAS THE RIGHT OR AUTHORITY TO RESOLVE ANY DISPUTE IN A CLASS ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR IN ANY OTHER PROCEEDING IN WHICH ANY PARTY ACTS OR AUTHORIZES TO ACT IN A REPRESENTATIVE CAPACITY. IF YOU DO NOT WISH TO BE BOUND BY THE BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER:(1) You must notify Louisville Slugger in writing within sixty (60) days of the date you purchased the Club; (2) Your written notice must be sent to Louisville Slugger, 1 Prudential Plaza, 130 E. Randolph Street, Suite 600, Chicago, IL 60601, Attn: Legal Department; and (3) Your written notice must include (a) your name, (b) your address, (c) the date you purchased the product, and (d) a clear statement that you wish to cancel the binding agreement to arbitrate and Class Action Waiver. Additionally, you can file an individual claim in small claims court in your country of residence (if you are in the United States) or in Cook County, Illinois. In this case, the provisions of the section “Binding Arbitration Agreement; Class Action Waiver (US Persons)” does not apply, but Small Claims Court rules and limitations apply.

How the law applies

This warranty gives you specific legal rights, and you may also have other rights which vary from state to state and province to province. This warranty applies to the maximum extent permitted by law.

Generally

No employee or representative of Louisville Slugger may modify this warranty. If any term of this Warranty, except the Class Action Waiver, is found to be unenforceable, that term will be removed from this Warranty and all other terms will remain in effect. If the class action waiver is found to be unenforceable, the entire section entitled “Binding Arbitration Agreement; Class Action Waiver (U.S. Residents Only)” does not apply. This warranty applies to the fullest extent not prohibited by law. This warranty is written in English (US). To the extent that any translated version of this Warranty conflicts with the English version, the English version will control.

In such cases, the remedies provided under this program are, to the fullest extent permitted by applicable law, the only remedies available to the affected club owner.
